DMCA Takedown Policy

1. Overview

TumbleT respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), TumbleT will respond expeditiously to claims of copyright infringement committed using our service.

2. Designated Agent

3. Filing a DMCA Takedown Notice

If you believe that content hosted on TumbleT infringes your copyright, please send a written notification containing the following information (per 17 U.S.C. § 512(c)(3)):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., a URL or description).
  4. Your contact information, including address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

4. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located.

Upon receiving a valid counter-notification, we will forward it to the original complaining party. If the original party does not file a court action within 10 business days, we may restore the removed content.

5. Repeat Infringer Policy

TumbleT will, in appropriate circumstances, terminate the accounts of users who are repeat infringers of copyright. We consider a "repeat infringer" to be any user who has been the subject of more than two valid DMCA takedown notices.

6. Good Faith

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages.
